Out-Of-State Spouse Filed for Divorce

My husband moved to California for work 4 years ago, but I stayed in our home state to raise the children. He just filed for divorce in California. Can I file for divorce here?

Unfortunately, once your husband lived in California for at least six months, he was legally able to file for divorce out here, and once the divorce is in one state, it is often times better to keep the entire case out there - trying to handle your divorce in two different states can be a nightmare. That said, if your children are still minors (under the age of 18), it may make sense to resolve the issues of custody and visitation in their home state, especially if they don’t have much contact with California.
