Hello, I have filed the request for a divorce, my spouse and I are on good terms and have agreed to how we want our community property split, he will be buying me out of the house by refinancing the house, do we have to wait until the divorced is finalized before he does the refinancing?

While you don’t have to wait until the divorce is finalized before resolving the issue of the community home, it’s best to have the protection of a formal court order outlining the terms of your agreement. You can do so by something called a Stipulation and Order, which is a written document signed by both of you and the judge that confirms how the buy out will occur, how much you will receive, etc.
