I share 50/50 custody with my ex. Our current judgment says we cannot move out of county with our daughter without prior consent from court and other parent. If I go back on active duty in the military what can my ex wife do as far as custody changes? Will she be able to move away and take temporary full custody while I’m active duty?
Active duty versus child custody
Regarding custody changes, unless you are stationed outside of the county (or in a location where 50/50 custody is no longer possible), it’s unlikely that any change would occur. If you are deployed or have a TDY assignment, while you’re gone, it’s likely that your daughter would stay with your ex. The goal is stability for your daughter - you being deployed should not be a stand alone reason for your ex to uproot your daughter and take her away.
